This Privacy Policy explains what personal data we collect, why we collect it, how we use and store it, and your rights under the Personal Data Protection Act 2010 (PDPA) — the primary legislation governing the processing of personal data in Malaysia.

Personal Data We Collect

To deliver our services — including company incorporation, company secretarial work, accounting, and tax compliance — we are required to collect certain personal data from directors, shareholders, and authorised representatives.

Identity & Identification Documents

  • Full legal name as per identity document
  • MyKad (NRIC) number for Malaysian nationals
  • Passport number, expiry date, and a copy of the passport for foreign nationals
  • Nationality and country of residence
  • Date of birth

Contact & Address Information

  • Residential or correspondence address
  • Email address and mobile number

Business & Corporate Information

  • Proposed or existing company name
  • Business nature and industry
  • Shareholding structure and percentage
  • Directorship roles and appointment details

We only collect data that is strictly necessary for the purposes described in this policy. We do not collect data speculatively or beyond what is required.

How We Use Your Data

Your personal data is used exclusively for legitimate business and regulatory purposes. Under the PDPA 2010, we are required to process your data only for purposes that you have been notified of and, where required, consented to.

We use your data to:

  • Submit incorporation documents to the Companies Commission of Malaysia (SSM)
  • Prepare and file statutory forms, resolutions, and annual returns
  • Maintain your company's statutory register as required under the Companies Act 2016
  • File tax returns and correspondence with Lembaga Hasil Dalam Negeri (LHDN)
  • Conduct client due diligence (CDD) in compliance with the Anti-Money Laundering Act (AMLA)
  • Communicate with you regarding your account, deadlines, and service updates
  • Issue invoices and process payments

We will never use your personal data for marketing purposes without your explicit consent, and we will never sell, trade, or rent your data to third parties.

Disclosure to Third Parties

Lite Incorp does not sell or share your personal data with third parties for commercial purposes. However, in the normal course of service delivery, your data may be disclosed to authorised parties as described below.

Regulatory & government bodies:

  • Companies Commission of Malaysia (SSM) — for incorporation and statutory filings
  • Lembaga Hasil Dalam Negeri (LHDN) — for tax registration and filing
  • Suruhanjaya Syarikat Malaysia — for company updates and changes
  • Bank Negara Malaysia or law enforcement — if required under AMLA or a court order

Service partners:

  • Licensed auditors engaged to conduct statutory audits on your behalf
  • Our secure cloud storage and document management service providers

All third-party service providers are bound by confidentiality obligations and are prohibited from using your data for any purpose beyond what is necessary to support Lite Incorp's services.

How We Store & Protect Data

We take the security of your personal data — especially sensitive documents such as passports and identity cards — extremely seriously. We employ a combination of technical and administrative safeguards to protect your data from unauthorised access, loss, or misuse.

Our security measures include:

  • Encrypted cloud storage for all uploaded identity documents
  • Access controls limiting document access to authorised personnel only
  • Secure password policies and two-factor authentication for internal systems
  • Regular security reviews of our data handling procedures
  • Physical document security where hard copies are held

Identity documents such as passport copies and MyKad scans are stored only for as long as they are needed for the purpose collected, or as required by Malaysian law. We do not retain documents beyond what is legally necessary.

In the event of a data breach that may affect your personal data, we will notify you and the relevant authorities in accordance with our obligations under Malaysian law.

Data Retention

Lite Incorp retains your personal data for as long as is necessary to fulfil the purposes for which it was collected, or as required by applicable Malaysian laws and regulations.

General retention periods:

  • Company statutory records — for the lifetime of the company and 7 years post-dissolution, as required under the Companies Act 2016
  • Accounting and tax records — minimum 7 years as required by LHDN
  • Client due diligence (CDD) records — minimum 6 years post-relationship, as required under AMLA
  • Identity documents — retained only while services are active, then securely deleted upon written request or end of engagement

Once the retention period expires, your data is securely destroyed or anonymised in a manner that prevents reconstruction or identification.

Your Rights Under PDPA 2010

As a data subject under Malaysia's Personal Data Protection Act 2010 (PDPA), you have the following rights with respect to your personal data held by Lite Incorp:

Right of access

You have the right to request access to the personal data we hold about you and to receive a copy of that data in a readable format.

Right of correction

You have the right to request that we correct any inaccurate, incomplete, or outdated personal data we hold about you.

Right to withdraw consent

Where processing is based on your consent, you have the right to withdraw that consent at any time. Please note that withdrawal may affect our ability to continue providing services to you.

Right to limit processing

You may request that we limit the use of your personal data to storage only, in circumstances where accuracy is disputed or processing is unlawful.

Cookies & Website Data

When you visit the Lite Incorp website, we may collect certain technical data automatically through the use of cookies and analytics tools. This data helps us understand how visitors use our site and improve your experience.

Cross-Border Data Transfers

Lite Incorp primarily stores and processes data within Malaysia. However, some of our cloud infrastructure and third-party software tools may process data in servers located outside Malaysia.

In such cases, we ensure that all cross-border data transfers comply with Section 129 of the PDPA 2010, which prohibits the transfer of personal data to a country outside Malaysia unless adequate protections are in place.

We only engage service providers that meet recognised international data security standards and are contractually bound to protect your data in accordance with Malaysian law.
